Article 3 - Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate, before the distance contract is concluded, how the general terms and conditions can be viewed at the entrepreneur’s premises and that they will be sent free of charge as soon as possible at the request of the consumer.
If the distance contract is concluded electronically, contrary to the previous paragraph, and before the distance contract is concluded, the text of these general terms and conditions may be made available to the consumer by electronic means in such a way that the consumer can easily store them on a durable medium. If this is not reasonably possible, it will be indicated where the general terms and conditions can be accessed electronically and that they will be sent electronically or otherwise free of charge at the consumer’s request.
If, in addition to these general terms and conditions, specific product or service conditions apply, the second and third paragraphs apply accordingly, and in the event of conflicting conditions, the consumer may always rely on the applicable provision that is most favorable to them.
If one or more provisions in these general terms and conditions are at any time wholly or partially void or annulled, the agreement and these conditions will remain in effect for the rest, and the provision in question will be replaced by mutual agreement without delay by a provision that approximates the original intent as closely as possible.
Situations not covered by these general terms and conditions should be assessed ‘in the spirit’ of these general terms and conditions.
Ambiguities regarding the interpretation or content of one or more provisions should also be interpreted ‘in the spirit’ of these general terms and conditions.
Article 4 - The Offer
If an offer is subject to a limited duration or made under certain conditions, this will be explicitly stated in the offer.
The offer is non-binding. The entrepreneur is entitled to modify and adjust the offer.
The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to allow the consumer to assess the offer properly. If the entrepreneur uses images, they are a truthful representation of the offered products and/or services. Obvious mistakes or errors in the offer do not bind the entrepreneur.
All images, specifications, and data in the offer are indicative and cannot be grounds for compensation or termination of the agreement.
Images accompanying products are a truthful representation of the products offered. The entrepreneur cannot guarantee that the displayed colors exactly match the real colors of the products.
Each offer contains information that makes it clear to the consumer what rights and obligations are associated with the acceptance of the offer. This particularly concerns:
the price including taxes;
any shipping costs;
the way the agreement will be concluded and what actions are necessary for this;
whether or not the right of withdrawal applies;
the method of payment, delivery, and execution of the agreement;
the period for accepting the offer, or the period during which the entrepreneur guarantees the price;
the amount of the rate for distance communication if the costs for using the means of distance communication are calculated on a different basis than the regular base rate for the used communication medium;
whether the agreement will be archived after its conclusion, and if so, how the consumer can access it;
the way in which the consumer, before concluding the agreement, can check and, if desired, correct the information provided by them in the context of the agreement;
any other languages in which, besides Dutch, the agreement can be concluded;
the codes of conduct to which the entrepreneur is subject and the way the consumer can consult these codes of conduct electronically; and
the minimum duration of the distance contract in the event of a duration transaction.
Article 5 - The Agreement
Subject to the provisions of paragraph 4, the agreement is concluded at the moment the consumer accepts the offer and complies with the conditions set.
If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by the entrepreneur, the consumer may dissolve the agreement.
If the agreement is concluded electronically, the entrepreneur shall take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment. If the consumer can pay electronically, the entrepreneur will observe appropriate security measures.
The entrepreneur may, within legal frameworks, inform themselves of whether the consumer can meet their payment obligations, as well as of all facts and factors relevant to a responsible conclusion of the distance contract. If the entrepreneur has good grounds based on this investigation not to enter into the agreement, they are entitled to refuse an order or request or to attach special conditions to the execution, stating reasons.
The entrepreneur shall provide the consumer with the following information, in writing or in such a way that the consumer can store it accessibly on a durable medium:
the physical address of the entrepreneur's establishment where the consumer can submit complaints;
the conditions under which and the manner in which the consumer may exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;
information about guarantees and existing after-sales service;
the data included in Article 4 paragraph 3 of these terms and conditions, unless the entrepreneur has already provided this data to the consumer before the execution of the agreement;
the requirements for terminating the agreement if the agreement has a duration of more than one year or is of indefinite duration.
In the case of a duration transaction, the provision in the previous paragraph applies only to the first delivery.
Every agreement is entered into under the suspensive condition of sufficient availability of the relevant products.
Article 6 - Right of Withdrawal
For the delivery of products:
When purchasing products, the consumer has the right to dissolve the agreement without stating reasons for 14 days. This reflection period starts the day after the consumer or a representative previously designated by the consumer and made known to the entrepreneur receives the product.
During the reflection period, the consumer will handle the product and packaging with care. They will only unpack or use the product to the extent necessary to assess whether they wish to keep the product. If they exercise their right of withdrawal, they will return the product with all delivered accessories and – if reasonably possible – in its original condition and packaging, in accordance with the reasonable and clear instructions provided by the entrepreneur.
If the consumer wishes to use their right of withdrawal, they are required to notify the entrepreneur within 14 days after receiving the product. The notification must be made via the model form or another means of communication, such as email. After the consumer has indicated they wish to exercise the right of withdrawal, the consumer must return the product within 14 days. The burden of proof that the delivered goods have been returned in time lies with the consumer, for example through proof of shipment.
If the customer has not indicated within the periods mentioned in paragraph 2 and 3 that they wish to use their right of withdrawal, or has not returned the product to the entrepreneur, the purchase is a fact.
For the delivery of services:
For the delivery of services, the consumer has the right to dissolve the agreement without stating reasons for at least 14 days, starting on the day the agreement is concluded.
To exercise their right of withdrawal, the consumer must follow the reasonable and clear instructions provided by the entrepreneur at the time of the offer and/or at the latest upon delivery.
Article 7 - Costs in Case of Withdrawal
The consumer shall bear the direct cost of returning the product.
If the consumer has paid an amount, the entrepreneur shall refund this amount as soon as possible, but at the latest within 14 days after the withdrawal. This is subject to the condition that the product has already been received back by the web retailer or conclusive proof of complete return can be provided. Refunds will be made using the same payment method used by the consumer unless the consumer expressly agrees to a different method.
If the product is damaged due to careless handling by the consumer, the consumer is liable for any depreciation in value of the product.
The consumer cannot be held liable for depreciation in value of the product if the entrepreneur has not provided all legally required information about the right of withdrawal, which must be done before the conclusion of the purchase agreement.
Article 8 - Exclusion of the Right of Withdrawal
The entrepreneur can exclude the consumer’s right of withdrawal for products as described in paragraph 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, or at least in good time before concluding the agreement.
Exclusion of the right of withdrawal is only possible for products:
that have been created by the entrepreneur according to the consumer's specifications;
that are clearly personal in nature;
that by their nature cannot be returned;
that can spoil or age quickly;
whose price is subject to fluctuations on the financial market over which the entrepreneur has no influence;
for individual newspapers and magazines;
for audio and video recordings and computer software of which the consumer has broken the seal;
for hygienic products whose seal has been broken by the consumer.
Exclusion of the right of withdrawal is only possible for services:
concerning accommodation, transport, restaurant business or leisure activities to be carried out on a specific date or during a specific period;
whose performance has begun with the express consent of the consumer before the reflection period has expired;
concerning bets and lotteries.
Article 9 - The Price
During the validity period stated in the offer, the prices of the offered products and/or services will not be increased, except for price changes due to changes in VAT rates.
Contrary to the previous paragraph, the entrepreneur may offer products or services with variable prices if these are subject to fluctuations in the financial market that are beyond the entrepreneur’s control. This link to fluctuations and the fact that any stated prices are guide prices will be stated in the offer.
Price increases within 3 months after the conclusion of the agreement are only permitted if they result from statutory regulations or provisions.
Price increases from 3 months after the conclusion of the agreement are only permitted if the entrepreneur has stipulated this and:
they result from statutory regulations or provisions; or
the consumer has the authority to terminate the agreement from the day on which the price increase takes effect.
The prices stated in the offer of products or services include VAT.
All prices are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors. In the event of printing and typographical errors, the entrepreneur is not obliged to deliver the product at the incorrect price.
Article 10 - Conformity and Warranty
The entrepreneur warrants that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations existing on the date of the conclusion of the agreement. If agreed, the entrepreneur also guarantees that the product is suitable for use other than normal use.
A guarantee provided by the entrepreneur, manufacturer, or importer does not affect the legal rights and claims that the consumer can assert against the entrepreneur based on the agreement.
The legal warranty applies to all products. The duration of the legal warranty may differ depending on the nature of the product.
Any defects or incorrectly delivered products must be reported to the entrepreneur in writing within 2 months after discovery.
The warranty does not apply if:
the consumer has repaired and/or modified the delivered products themselves or had them repaired and/or modified by third parties;
the delivered products have been exposed to abnormal conditions or otherwise treated carelessly or contrary to the instructions of the entrepreneur and/or on the packaging;
the defect is wholly or partly the result of regulations that the government has set or will set regarding the nature or quality of the materials used.
Article 11 - Delivery and Performance
The entrepreneur will exercise the utmost care when receiving and carrying out orders for products and when assessing requests for the provision of services.
The place of delivery is the address that the consumer has made known to the company.
Subject to the provisions of paragraph 4 of this article, the company shall execute accepted orders with due speed but at the latest within 30 days, unless the consumer has agreed to a longer delivery period. If the delivery is delayed, or if an order cannot be carried out or only partially, the consumer will be informed about this at the latest 30 days after placing the order. In that case, the consumer has the right to dissolve the agreement free of charge. The consumer is not entitled to any contractual compensation.
All delivery terms are indicative. The consumer cannot derive any rights from any stated terms. Exceeding a term does not entitle the consumer to any compensation.
In case of dissolution in accordance with paragraph 3 of this article, the entrepreneur shall refund the amount paid by the consumer as soon as possible, but at the latest within 14 days after dissolution.
If delivery of an ordered product proves impossible, the entrepreneur will make an effort to provide a replacement article. At the latest upon delivery, it will be stated clearly and understandably that a replacement article is being delivered. The right of withdrawal cannot be excluded for replacement articles. The costs of any return shipment are at the entrepreneur’s expense.
The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer or a previously designated representative made known to the entrepreneur, unless expressly agreed otherwise.
Article 12 - Duration Transactions: Duration, Termination, and Renewal
Termination
The consumer may terminate an agreement that was concluded for an indefinite period and that involves the regular delivery of products (including electricity) or services at any time, subject to the agreed termination rules and a notice period of no more than one month.
The consumer may terminate an agreement that was concluded for a definite period and that involves the regular delivery of products (including electricity) or services at any time at the end of the definite period, subject to the agreed termination rules and a notice period of no more than one month.
The consumer may terminate the agreements referred to in the previous paragraphs:
at any time and not be restricted to termination at a specific time or during a specific period;
at least in the same way as they were entered into by the consumer;
always with the same notice period as the entrepreneur has stipulated for themselves.
Renewal
A contract concluded for a definite period and that involves the regular delivery of products or services may not be automatically extended or renewed for a fixed term.
Contrary to the previous paragraph, a contract concluded for a definite period and that involves the regular delivery of daily, news, and weekly newspapers and magazines may be extended automatically for a fixed period of up to three months, provided that the consumer can terminate this extended contract by the end of the extension with a notice period of no more than one month.
A contract concluded for a definite period and that involves the regular delivery of products or services may only be renewed automatically for an indefinite period if the consumer may terminate at any time with a notice period of no more than one month and a notice period of no more than three months in case the contract involves the regular, but less than monthly, delivery of daily, news, and weekly newspapers and magazines.
A limited duration contract for the regular delivery of daily, news, and weekly newspapers and magazines for introduction purposes (trial or introductory subscription) shall not be automatically continued and ends automatically after the trial or introductory period.
Duration
If a contract has a duration of more than one year, the consumer may terminate the contract at any time after one year with a notice period of no more than one month, unless reasonableness and fairness dictate otherwise.
Article 13 - Payment
Unless otherwise agreed, the amounts owed by the consumer must be paid within 7 working days after the start of the reflection period referred to in Article 6 paragraph 1. In the case of an agreement to provide a service, this period starts after the consumer has received confirmation of the agreement.
The consumer has the duty to report inaccuracies in provided or stated payment details to the entrepreneur without delay.
In case of non-payment by the consumer, the entrepreneur has the right, subject to legal restrictions, to charge the consumer the reasonable costs previously made known to them.
Article 14 - Complaints Procedure
The entrepreneur has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.
Complaints about the execution of the agreement must be submitted to the entrepreneur within 2 months after the consumer has discovered the defects, clearly and fully described.
Complaints submitted to the entrepreneur shall be answered within 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within 14 days with a confirmation of receipt and an indication of when the consumer can expect a more detailed response.
If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.
In the event of complaints, a consumer must first contact the entrepreneur. If the web shop is affiliated with WebwinkelKeur and complaints cannot be resolved in mutual consultation, the consumer should contact WebwinkelKeur (www.webwinkelkeur.nl), which will mediate free of charge. Check if this web shop has a current membership via https://www.webwinkelkeur.nl/ledenlijst/. If a solution is still not reached, the consumer has the option to have their complaint handled by the independent dispute committee appointed by WebwinkelKeur, the decision of which is binding and both entrepreneur and consumer agree to this binding decision. A fee is associated with submitting a dispute to this dispute committee, which the consumer must pay to the relevant committee.
A complaint does not suspend the entrepreneur’s obligations, unless the entrepreneur states otherwise in writing.
If a complaint is found to be justified by the entrepreneur, the entrepreneur will, at their discretion, either replace or repair the delivered products free of charge.
Article 15 - Disputes
Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law, even if the consumer resides abroad.
The Vienna Convention on Contracts for the International Sale of Goods does not apply.
Article 16 - Additional or Deviating Provisions
Additional provisions or provisions deviating from these general terms and conditions may not be to the consumer’s detriment and must be recorded in writing or in such a way that the consumer can store them accessibly on a durable medium.
Refurbished product condition
Products offered as refurbished are previously used electronic devices that have been professionally cleaned, tested, and, where necessary, repaired by the entrepreneur or its suppliers. Such products may show minor signs of use such as scratches or discoloration, which do not affect functionality. The exact condition is specified in the product description.
Warranty on refurbished products
A warranty period of twelve (12) months applies to refurbished products, unless stated otherwise. For consumable components such as batteries or power adapters, a warranty of three (3) months applies unless explicitly stated otherwise. The warranty only covers defects not caused by misuse, impact damage, or unauthorized repairs by third parties.
Battery capacity
For devices containing an internal battery, the battery capacity at the time of delivery will be at least 80% of the original capacity unless otherwise stated. Reduced battery capacity is not considered a defect as long as the device functions properly.
Replacement in case of defects
If a product cannot be repaired during the warranty period, the entrepreneur reserves the right to offer a functionally equivalent or better replacement. If no replacement is possible, a full refund will be issued.
Data wiping and privacy
Devices with data storage will be wiped according to industry standards before delivery. The entrepreneur is not liable for any data that may have remained from previous users.
Depreciation in case of withdrawal
If the consumer returns a product in a condition that does not match its original state or shows signs of extensive use, the entrepreneur reserves the right to deduct a reasonable depreciation amount from the refund.
Unique inventory
Refurbished products are generally unique items. In the event of simultaneous purchases of the same product, the entrepreneur reserves the right to cancel the order and issue a refund, unless a functionally equivalent alternative can be offered.
Applicability
These terms and conditions apply to the purchase of used electronic devices by the entrepreneur through an online trade-in platform or valuation software, whereby a private or business customer ("the seller") may offer a device for sale in exchange for monetary payment or store credit.
Ownership Declaration
The seller declares to be the sole lawful owner of the offered device and entitled to sell it. The entrepreneur reserves the right to request proof of ownership at its sole discretion. In case of suspicion of theft or fencing, the entrepreneur will report the matter to the competent authorities.
Obligations of the Seller
The seller is responsible for providing a truthful, complete, and accurate description of the device, including its functional condition, visible damage, original parts, accessories, and other relevant characteristics.
The seller must remove all personal data (such as user accounts, stored information, passwords) from the device prior to shipping. The entrepreneur accepts no liability for residual data or the consequences of misuse thereof.
Indicative Valuation
Any value shown by the software is a non-binding indicative price based on the information entered by the seller. The entrepreneur reserves the right to adjust the final purchase value after inspection or to reject the offer without charge if:
a) the device does not match the provided information;
b) the device shows technical or cosmetic damage that was not disclosed;
c) the software-generated valuation was affected by technical faults or input errors.
Inspection and Final Approval
Upon receipt of the device, the entrepreneur will perform a technical and visual inspection. If the actual condition matches the seller’s description, the agreed amount will be paid out or credited to the seller’s store account within 5 working days.
If discrepancies are found, the seller will receive a revised offer. If no response is received within 14 working days, the device will be returned at no cost to the seller.
Software Errors and Liability Disclaimer
The seller acknowledges that the valuation software depends on technical parameters, user input, and external data. The entrepreneur is not liable for incorrect price determinations resulting from bugs, network failures, typographical errors, database corruption, or human mistakes.
The entrepreneur reserves the right to unilaterally cancel any transaction in the event of clear pricing errors or abuse.
Shipping and Risk Transfer
The seller is responsible for securely packaging the device for shipment. The risk of loss or damage during transport remains with the seller until the package is demonstrably received by the entrepreneur.
In case of shipping damage or missing items, the entrepreneur reserves the right to adjust the purchase value or reject the transaction.
Depreciation and Technical Damage
If, during inspection, the device is found to have technical faults or irreparable damage (e.g., water damage, motherboard failure, or account locks), this is considered a depreciation factor. The purchase offer may be revised or withdrawn accordingly.
Personal Data Processing
The entrepreneur processes the seller’s personal data solely for the execution of the trade-in agreement and in compliance with applicable privacy legislation. Please refer to our privacy policy for further details.

a) het apparaat niet overeenkomt met de opgegeven gegevens;
b) het apparaat technische of cosmetische schade bevat die niet is gemeld;
